Caution
Like other grammar patterns that include では, the は particle can be dropped. However, keep in mind that は emphasizes the negative, so removing it will slightly soften the statement.

Fun Fact
When used with the verb する, there is a unique grammatical exception. Both するべき and the shortened form すべき are considered correct and can be used interchangeably.
